Madrid, September 22, 2021 – The DigitalES association has prepared a joint statement with AERC, the Spanish Commercial Broadcasting Association, and UTECA, the Union of Commercial Television Broadcasters. The three employers’ associations, representing the television, radio and technology industries, are asking the Congress of Deputies to reject tomorrow an amendment that would modify a key point of the Intellectual Property Law.
By virtue of this amendment, the First Section of the Intellectual Property Commission (SPCPI), a body attached to the Ministry of Culture and Sports, will be able to determine the fees of the entities without adjusting to a previous methodology developed in a Ministerial Order, as established in the current legislation on intellectual property.
For these associations, a potential change in the tariff-setting methodology should be channeled through an ordinary legislative procedure that guarantees a full parliamentary debate and offers all the sectors concerned the opportunity to participate in a public consultation or information process.
